Refund Policy

Our Commitment: We want you to be completely satisfied with CVApplyr. This Refund Policy explains the circumstances under which refunds may be issued for credit purchases and subscriptions.

1. Overview

This Refund Policy applies to all purchases made through the CVApplyr mobile application and web platform, operated by zSellr Enterprises LLP. By making a purchase, you acknowledge and agree to this policy.

2. Credit Purchases

2.1 General Refund Policy for Credits

All credit purchases are generally non-refundable once the credits have been added to your account. This is because credits can be used immediately upon purchase, and we cannot verify whether credits have been used or not.

2.2 What Credits Include

When you purchase credits, you gain access to:

  • AI Cover Letter Generation: Generate personalized cover letters using Google Gemini AI
  • Company Research: Automated research on companies and job positions
  • Email Sending: Send job applications via email
    • OAuth Users (Google/Microsoft): Send from your personal email account
    • Email/Password Users: Send from our SMTP server (cv@cvapplyr.com)
  • Email Reply Detection (OAuth Users Only): Automatically check your inbox for employer replies at no additional cost
  • Application Tracking: Track all applications and responses in your dashboard
  • Document Management: Store and organize resumes, photos, and signatures

Note: Email reply detection is available only to users who authenticate with Google or Microsoft OAuth and grant email reading permissions. This feature does not consume additional credits.

2.3 Exceptions for Credit Refunds

We may issue a full refund for credit purchases in the following circumstances:

  • Technical Errors: If you were charged but credits were not added to your account due to a system error
  • Duplicate Charges: If you were charged multiple times for the same transaction
  • Unauthorized Transactions: If your account was compromised and purchases were made without your authorization (subject to verification)
  • Service Failure: If our Service was unavailable or non-functional at the time of purchase, preventing you from using your credits
  • Within 24 Hours: If you contact us within 24 hours of purchase AND have not used any of the purchased credits

2.4 Partial Refunds

In cases where you have used some but not all of your purchased credits, we may offer a partial refund calculated as:

  • Refund Amount = (Unused Credits / Total Credits Purchased) × Purchase Price
  • Minus any applicable transaction fees

Note: Partial refunds are granted at our sole discretion and are evaluated on a case-by-case basis.

3. Free Trial Credits

Free trial credits are non-refundable as they are provided at no cost. Free trial credits:

  • Are provided automatically upon new account registration (5 credits)
  • Cannot be transferred between accounts
  • Do not expire unless your account is terminated
  • Are forfeited if your account is suspended or terminated for violations of our Terms of Service

4. Subscription Plans (Future Implementation)

Note: Subscription plans are not currently available but may be introduced in the future. This section will apply when subscriptions are launched.

4.1 Subscription Refund Policy

When subscriptions are available:

  • Monthly Subscriptions: Refunds may be issued within 7 days of the initial purchase if no more than 10% of monthly credits have been used
  • Annual Subscriptions: Refunds may be issued within 14 days of purchase if no more than 5% of annual credits have been used
  • Auto-Renewals: You can cancel auto-renewal at any time, but refunds for the current billing period will not be issued unless the cancellation occurs within the refund window

4.2 Subscription Cancellation

When subscriptions are available, you may cancel at any time:

  • Cancellations take effect at the end of the current billing period
  • You will retain access to subscription benefits until the end of the paid period
  • No refunds will be issued for the unused portion of the current billing period (unless within the refund window)

5. Refund Request Process

5.1 How to Request a Refund

To request a refund, please follow these steps:

  1. Email us at: support@cvapplyr.com or support@cvapplyr.com
  2. Include the following information:
    • Your full name and registered email address
    • Transaction ID or order number
    • Date of purchase
    • Amount charged
    • Reason for refund request
    • Any supporting documentation (screenshots, error messages, etc.)
  3. Subject line: "Refund Request - [Your Email]"

5.2 Refund Processing Timeline

We will review and respond to refund requests according to the following timeline:

  • Initial Response: Within 48 business hours
  • Investigation: Up to 5 business days
  • Refund Processing: If approved, refunds are processed within 5-7 business days
  • Credit to Your Account: Depending on your bank or payment provider, refunds may take an additional 5-10 business days to appear in your account

5.3 Refund Methods

Approved refunds will be issued using the original payment method:

  • Credit/Debit Card: Refunded to the original card
  • Net Banking: Refunded to the original bank account
  • Digital Wallets: Refunded to the original wallet
  • UPI: Refunded to the original UPI ID

Note: We cannot issue refunds to a different payment method than was used for the original purchase.

6. Non-Refundable Items and Services

The following are non-refundable under all circumstances:

  • Credits that have already been used to generate cover letters
  • Cover letters that have been successfully generated and delivered
  • Credits used for applications that have been sent
  • Free trial credits (as they were provided at no cost)
  • Promotional or bonus credits
  • Credits purchased more than 90 days ago (unless due to technical error)
  • Credits purchased during promotional sales or discounts (subject to specific terms of the promotion)

7. Service Limitations and Refunds

7.1 AI-Generated Content Quality

We do not offer refunds based on dissatisfaction with AI-generated cover letter quality. Here's why:

  • AI-generated content is inherently variable and should be reviewed/edited by users
  • Quality is subjective and depends on input quality (resume, job details)
  • We provide preview and editing capabilities before finalizing applications
  • Users are expected to review and customize generated content

7.2 Job Application Outcomes

We do not guarantee job interviews, offers, or employment outcomes. Refunds will not be issued based on:

  • Not receiving responses from employers
  • Not getting job interviews
  • Not receiving job offers
  • Rejection from job applications

The effectiveness of job applications depends on many factors beyond our control, including qualifications, competition, employer preferences, and market conditions.

7.3 Email Delivery Issues

Refunds for email delivery issues are handled case-by-case:

  • Refundable: If emails fail to send due to our system errors and we cannot resend them
  • Non-Refundable: If emails are blocked by recipient spam filters, or if recipient email addresses are invalid
  • OAuth Email Features: If you revoke email permissions in your Google/Microsoft account, email-based features (send from your account, check replies) will stop working. This does not constitute grounds for a refund as the Service remains functional using alternative methods (our SMTP server)

7.4 Email Reply Detection

Email reply detection is a free feature for OAuth users:

  • No additional credits are consumed when checking for replies
  • Requires Mail.Read permission (Microsoft) or gmail.readonly (Google)
  • If you revoke email reading permissions, this feature will stop working but does not affect other features
  • No refunds are issued for inability to use reply detection due to denied permissions

8. Chargebacks and Disputes

8.1 Contact Us First

Before initiating a chargeback with your bank or payment provider, please contact us directly. We are committed to resolving issues promptly and fairly.

8.2 Chargeback Consequences

If you initiate a chargeback:

  • Your account may be immediately suspended pending investigation
  • All credits (purchased and free) will be frozen
  • If the chargeback is found to be unjustified:
    • Your account may be permanently terminated
    • You may be blocked from creating new accounts
    • You may be liable for chargeback fees and legal costs
  • If the chargeback is justified, we will cooperate fully with the investigation and provide a full refund

8.3 Fraudulent Chargebacks

Fraudulent chargebacks (claiming non-delivery after receiving credits/services) may result in:

  • Permanent account termination
  • Legal action to recover damages
  • Reporting to fraud prevention agencies

9. Special Circumstances

9.1 Service Outages

If our Service experiences extended downtime (more than 24 consecutive hours):

  • We may extend credit expiration dates
  • We may provide compensation in the form of bonus credits
  • Refunds will be considered for purchases made immediately before or during the outage

9.2 Account Termination by Us

If we terminate your account for violations of our Terms of Service:

  • No refunds will be issued for unused credits
  • All credits (purchased and free) will be forfeited
  • This is stated clearly in our Terms of Service

9.3 Account Deletion by You

If you voluntarily delete your account:

  • Unused credits will be forfeited (no refunds)
  • You have 7 days to cancel the deletion and restore your account with credits intact
  • After 7 days, deletion is permanent and credits cannot be recovered

10. Regional Refund Rights

10.1 European Union (EU) Customers

Under EU Consumer Rights Directive, you have the right to withdraw from a purchase within 14 days without giving a reason, except:

  • Digital content (credits) that has been used or partially used
  • Services that have been fully performed with your prior consent

To exercise your right of withdrawal, contact us at support@cvapplyr.com within 14 days of purchase, provided you have not used any credits.

10.2 India Customers

As per Indian consumer protection laws:

  • Refunds for defective digital services may be claimed within 30 days
  • Disputes may be escalated to consumer courts if not resolved within 30 days
  • We comply with all RBI (Reserve Bank of India) guidelines for digital payment refunds

10.3 United States Customers

Refund rights vary by state. Some states provide additional consumer protections. Contact us to discuss state-specific refund rights.

10.4 Other Regions

If you are in a region with specific consumer protection laws not listed here, those laws will apply to the extent they provide greater protections than this policy.

11. Refund Approval Criteria

When evaluating refund requests, we consider:

  • Time since purchase
  • Credits used vs. unused
  • Nature of the issue (technical error, dissatisfaction, etc.)
  • Account history and past refund requests
  • Evidence and documentation provided
  • Compliance with our Terms of Service

12. Refund Limitations

  • Maximum Refund Frequency: We may limit refunds to once per account per 12-month period (except for technical errors or unauthorized charges)
  • Abuse Prevention: Repeated refund requests may result in account suspension
  • Discretionary Decisions: All refund decisions are made at our sole discretion
  • Final Decision: Our decision on refund requests is final

13. Alternative Remedies

If you're not eligible for a refund, we may offer alternative remedies:

  • Bonus Credits: Additional free credits to compensate for issues
  • Technical Support: Assistance to resolve problems with the Service
  • Account Credits: Credit toward future purchases
  • Feature Access: Temporary access to premium features

This Refund Policy is governed by the laws of India. Any disputes related to refunds shall be subject to the exclusive jurisdiction of courts in Gurgaon, Haryana, India.
