Welcome to CVApplyr! These Terms of Service ("Terms") govern your use of the CVApplyr mobile application and web platform (collectively, the "Service") operated by zSellr Enterprises LLP ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using CVApplyr, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including visitors, registered users, and premium subscribers.

2. Eligibility

You must be at least 18 years old to use our Service. By using CVApplyr, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into these Terms
You will use the Service only for lawful purposes
You will not use the Service if you have been previously suspended or removed from the Service

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must register for an account. You may register using:

Email and password authentication
Google OAuth authentication (personal Gmail accounts)
Microsoft OAuth authentication (Outlook, Hotmail, Office 365 accounts)

3.2 OAuth Authentication

When you sign in using Google or Microsoft OAuth, you authorize us to:

Access your profile information: Name, email address, profile picture
Send emails on your behalf: Send job applications from your email account (Google Gmail or Microsoft Outlook)
Read your email messages: Check your inbox for employer replies to your job applications
Maintain authentication tokens: Securely store OAuth tokens to keep you logged in

Important: We only access your emails to detect replies to applications sent through CVApplyr. We do not read, store, or share the content of your personal emails. You can revoke these permissions at any time through your Google or Microsoft account settings.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach
Ensuring your account information is accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms
Your account is used for fraudulent or illegal activities
You provide false or misleading information
Your account remains inactive for more than 12 months

4. Service Description

CVApplyr is an AI-powered cover letter generation and job application management platform. Our Service includes:

Cover Letter Generation: AI-powered personalized cover letters based on your resume and job details using Google Gemini AI
Company Research: Automated research on companies and job positions
Email Integration: Send applications directly from your Gmail or Microsoft Outlook account
Email Reply Detection: Automatically check your inbox for employer replies to applications (OAuth users only)
Application Tracking: Track your job applications, responses, and reply dates
Profile Management: Store and manage your resume, photos, digital signature, and professional information
Recipient Management: Save and organize job application recipients with company details
Application History: View detailed history of all sent applications with status tracking

5. Email Features and Permissions

5.1 Email Sending

When you send job applications through CVApplyr:

OAuth Users (Google/Microsoft): Emails are sent directly from your personal email account, showing your email address as the sender
Email/Password Users: Emails are sent through our SMTP server (cv@cvapplyr.com) on your behalf
We attach your resume and cover letter as PDF files
We track whether emails were successfully sent

5.2 Email Reply Detection

For users who authenticate with Google or Microsoft OAuth:

You can use the "Check Replies" feature to automatically scan your inbox for employer responses
We check only for emails from companies you applied to through CVApplyr
We match emails by sender address and date to identify relevant replies
We update your application status when replies are detected
We do not read, store, or access the content of the reply emails
We only record that a reply was received and the date it was received

5.3 Email Privacy Commitment

We are committed to protecting your email privacy:

✅ We ONLY check for replies to applications sent through CVApplyr
✅ We NEVER access your personal emails unrelated to job applications
✅ We DO NOT read the content of any emails
✅ We DO NOT share your emails with third parties
✅ We ONLY use email access for the specific features you authorize
✅ You can revoke email access at any time through your Google/Microsoft account settings

5.4 OAuth Token Security

When you authenticate with OAuth:

We securely store OAuth access tokens encrypted in our database
Tokens are used only for authorized actions (sending emails, checking replies)
We never share your tokens with third parties
Tokens are automatically refreshed to maintain your login session
You can revoke our access at any time by disconnecting CVApplyr from your Google/Microsoft account

5.1 Credit System

Our Service operates on a credit-based system:

Each cover letter generation consumes 1 credit
New users receive 5 free trial credits upon registration
Credits are non-refundable except as specified in our Refund Policy
Credits do not expire unless your account is terminated

5.2 Credit Packages

We offer various credit packages for purchase. Current pricing and packages are available in the app and on our website. Prices are subject to change with 30 days' notice to existing users.

5.3 Payment Processing

Payments are processed securely through third-party payment processors (Stripe, Razorpay). By making a purchase, you agree to the payment processor's terms of service.

5.4 Taxes

All prices are exclusive of applicable taxes unless otherwise stated. You are responsible for paying all applicable taxes associated with your purchases.

6. Intellectual Property Rights

6.1 Our Content

The Service, including all software, text, graphics, logos, and other content (excluding user-generated content), is owned by zSellr Enterprises LLP and is protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain all rights to the content you upload to the Service, including:

Your resume
Your profile information
Your photos and signature

6.3 License to Use Your Content

By uploading content to our Service, you grant us a limited, non-exclusive, royalty-free license to:

Process and analyze your content to generate cover letters
Store your content on our secure servers
Use your content to improve our AI algorithms (in anonymized form only)

6.4 Generated Cover Letters

You own all cover letters generated through our Service. However, you acknowledge that:

Generated content is AI-assisted and should be reviewed before use
We do not guarantee the accuracy or effectiveness of generated content
Similar cover letters may be generated for other users with similar profiles

7. Acceptable Use Policy

You agree NOT to use the Service to:

Generate false, misleading, or fraudulent content
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Upload malicious code, viruses, or harmful software
Attempt to gain unauthorized access to our systems
Harass, abuse, or harm other users
Use the Service for automated or bulk generation beyond reasonable personal use
Reverse engineer, decompile, or disassemble any part of the Service
Resell or redistribute the Service or generated content commercially
Create multiple accounts to abuse free trial credits

8. AI-Generated Content Disclaimer

IMPORTANT: Cover letters and other content generated by our Service are AI-assisted and based on algorithms. You acknowledge and agree that:

Generated content may contain errors, inaccuracies, or inconsistencies
You are solely responsible for reviewing, editing, and verifying all generated content
We do not guarantee that generated content will result in job interviews or offers
AI-generated content should not be considered professional career advice
You should customize and personalize generated content for each application

9. Third-Party Services

Our Service integrates with third-party services including:

Google OAuth (authentication)
Google Gemini AI (content generation)
Stripe (payment processing)
Razorpay (payment processing)
Email service providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party services.

10. Data Privacy and Security

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
We are not liable for any job application outcomes or employment decisions
We are not liable for damages caused by third-party services

12. Indemnification

You agree to indemnify, defend, and hold harmless zSellr Enterprises LLP, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you submit or generate through the Service

13. Modifications to Service and Terms

13.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13.2 Terms Modifications

We may update these Terms from time to time. We will notify you of material changes by:

Posting the updated Terms on our website
Sending an email notification to your registered email address
Displaying an in-app notification

Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

Using the account deletion feature in your profile settings

14.2 Termination by Us

We may terminate or suspend your account immediately if:

You breach these Terms
We are required to do so by law
Your account is used for fraudulent activities
Continuing to provide the Service would create legal liability

Upon termination:

Your access to the Service will be immediately revoked
Unused credits will be forfeited (no refunds unless legally required)
We will delete your personal data within 30 days (subject to legal retention requirements)
Sections of these Terms that by their nature should survive termination will remain in effect

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Gurgaon, Haryana, India.

15.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions or class arbitrations.

16. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country subject to international sanctions.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and zSellr Enterprises LLP regarding the Service.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or successor without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.

19. Special Provisions for Mobile Applications

19.1 App Store Terms

If you access the Service through a mobile application downloaded from the Apple App Store or Google Play Store, you acknowledge and agree that:

These Terms are between you and zSellr Enterprises LLP, not with Apple Inc. or Google LLC
Apple and Google are not responsible for the Service or its content
Apple and Google have no obligation to provide maintenance or support services
Apple and Google are not responsible for addressing any claims relating to the Service
You must comply with the respective app store's terms of service

19.2 Mobile Device Requirements

You are responsible for:

Obtaining a compatible mobile device
Maintaining internet connectivity
Paying any data charges incurred by using the mobile app
Keeping your mobile app updated to the latest version

By using CVApplyr, you acknowledge that you have read and understood these Terms of Service and agree to be bound by them.
